This document provides the terms under which you use Stamp Me.

Stamp Me is owned and operated by Stamp Media Pty Ltd (Stamp Media) trading as Stamp Loyalty (ACN 153 529 616), Melbourne, Australia. 

The Terms and Conditions were last updated on 24 October 2024. Stamp Media has the right to change these Terms and Conditions at any time and will post updates on this website and App.

Definitions

  1. App: Refers to the Stamp Me loyalty rewards application available for download on smartphones and other devices.
  2. Service: The loyalty rewards platform provided by Stamp Media through the App, including any updates or enhancements.
  3. User: Any individual who downloads, instals, or uses the Stamp Me App.
  4. Business Partner: Any merchant or business that offers loyalty rewards or other promotions through the Stamp Me App.
  5. Account: A personal account created by a User within the App, requiring registration with basic contact details such as name and email address.
  6. Reward: The benefit or discount offered by a Business Partner, which is earned by a User for engaging with the loyalty program.
  7. Terms: Refers to this document, which outlines the rules, conditions, and legal agreements governing the use of the Service.
  8. Stamp Media: Refers to Stamp Media Pty Ltd, the owner and operator of the Stamp Me App.
  9. Content: Any text, images, or data provided by Stamp Media, Business Partners, or Users within the App.

By downloading, installing and using the Stamp Me application on your Smartphone you (user) acknowledge and agree to the following terms:

1.0 Fair and Responsible Use

1.1 The Stamp Me loyalty rewards application is provided by Stamp Media for personal use only. It may not be used for commercial purposes without prior written consent from Stamp Media.

1.2 Users must ensure their contact details are up to date and accurate to receive communications and rewards.

1.3 Users are responsible for keeping their login credentials, including usernames and passwords, confidential. Any unauthorized use of the App must be reported immediately to Stamp Media.

1.4 Users must not interfere with or tamper with the Stamp Me application, its related websites, or any technical systems associated with it.

1.5 Users must not engage in any illegal activities, provide false or misleading information during account setup, or misuse the loyalty rewards system, including any fraudulent behavior aimed at obtaining rewards dishonestly.

1.6 Abusive behavior, including harassment or offensive communications towards business partners or other users, is strictly prohibited. Stamp Media reserves the right to terminate user accounts for any behavior deemed inappropriate or in violation of these terms.

1.7 Users must not attempt to reverse-engineer, modify, or otherwise tamper with the Stamp Me App or any associated software.

1.8 Violations of this section may result in the immediate suspension or termination of the user’s account, as well as potential legal action.

2.0 Right of Refusal

2.1 Conditions of the offer are provided by the named business on the phone application. The named business is able to vary its offer and ultimately has the final right of refusal on the provision of the specified reward.

2.2 Stamp Me reserves the right to modify or alter the terms and conditions of its loyalty reward program at any time

2.3 Stamp Me reserves the right to terminate a users membership to the application at any time if we believe these conditions have been breached

3.0 Information About You

3.1 You consent to us using the application to collect information about you. In its most basic form, we require your name and a current email address to activate an account with Stamp Me. Any additional personal information you provide to us will be used for the purposes of providing you with relevant discounts and offers for goods and services or relevant information regarding the Stamp Me Loyalty service. 3.2 Stamp Media complies with recent changes to European law with regards to data privacy and your rights, in particular, the General Data Protection Regulation 2016 (GDPR) which comes into effect on 25 May 2018 for customers residing in the EEA. Please see our Privacy Policy for more information.

3.3 We will not sell or pass on your personal information to a third party other than merchants, businesses and Stamp Media partners that you join offers with, within the app, will be able to contact you through the Stamp Me application, email or SMS. You are able to unsubscribe from these services and businesses when you receive any communication. As Stamp Me is a free application for the user to download, we do not require any financial information from the user.

3.4 Stamp Me Loyalty App and Platform is not a Social Media or Social Networking Site. There is no sharing of data or communication between the members of the Stamp Me Loyalty App.

4.0 Limitation of Liability; Indemnity

4.1 By using the Stamp Me App, you agree to use it at your own risk. Stamp Media and its business partners are not responsible for any claims or damages you may experience from using the Service.

4.2 Stamp Media is not liable for any direct or indirect losses, including but not limited to loss of opportunity, profits, or data, that arise from your use of the Service. This applies whether the issue is due to a mistake, error, technical problem, virus, or any other cause, including factors outside our control, like natural disasters or theft.

4.3 In no event will Stamp Media’s total liability to you exceed the total amount you paid for using the Service in the three months before the issue occurred.

4.4 You agree to defend, indemnify, and hold Stamp Media and its partners harmless from any claims, damages, or losses that result from your use of the Service, including any issues that arise from information you provide to us, such as defamation or infringement of intellectual property rights.

5.0 Applicable Law

5.1 The Service is operated by Stamp Media from its site in Melbourne, Australia. You and Stamp Media both benefit from establishing a predictable legal environment regarding the Service. Therefore, you and Stamp Media explicitly agree that all disputes, claims, or other matters arising from or relating to your use of the Service will be governed by the laws of Victoria and the national laws of Australia applicable therein.

5.2 Dispute Resolution: In the event of any dispute or claim arising out of or relating to these Terms, the Service, or any related matter, you agree to first attempt to resolve the dispute informally by contacting Stamp Media. If the dispute cannot be resolved through informal negotiations, both parties agree to submit the matter to mediation or arbitration before pursuing litigation. The mediation or arbitration will take place in Melbourne, Victoria, and both parties will share the cost equally unless otherwise agreed. If mediation or arbitration is unsuccessful, either party may then pursue litigation, subject to the governing law as set out in clause 5.1.

6.0 Miscellaneous

6.1 If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, this will not affect the validity and enforceability of any remaining provisions. Stamp Media may assign any or all of its rights under these Terms to any party without your consent. You are not permitted to assign any of your rights or obligations under these Terms without the prior written consent of Stamp Media, and any such attempted assignment will be void and unenforceable. These Terms constitute the entire agreement between you and Stamp Media regarding your use of the Service, and supersede all other Terms or purported agreements.
